Terms of business
Terms of business
These terms apply to your use of the test Motors website and to any vehicle you purchase from us. By using the site or buying a vehicle, you agree to them.
1. Who we are
test Motors is a motor dealer based at 6 Kidd Road, Chichester, PO19 6YF. Company number 292929292929; VAT number CH6767676767; FCA consumer credit firm reference 123456.
2. Vehicles & descriptions
We list each vehicle with the spec, mileage, MOT history and price as accurate as we can make it on the listing date. Stock turns over quickly; vehicle availability is not guaranteed until we've taken your reservation deposit. Photos are representative — minor cosmetic differences may exist; we'll point out anything material before you commit.
We're an independent dealer, not the manufacturer. Manufacturer warranties (where still in force) belong to the original buyer terms; ask us for the remaining warranty period on any specific vehicle.
3. Reservations
You can reserve a vehicle online with a refundable deposit (typically £199). The reservation holds the vehicle for 48 hours. If you decide not to proceed within that window, your deposit is automatically refunded in full. After 48 hours the reservation lapses and the vehicle returns to general sale.
Once you proceed to purchase, the deposit is applied against the balance.
4. Test drives
Test drives are by appointment. You'll need to bring a valid driving licence. We may decline a test drive at our discretion (insurance reasons, condition of the vehicle, etc.).
5. Distance selling
If you buy a vehicle entirely at distance (online, by phone, or by email) without ever visiting us in person, you have a 14-day right to cancel under the Consumer Contracts Regulations 2013, except where:
- The vehicle has been driven more than 1,000 miles since collection
- The vehicle has been damaged whilst in your care
- The contract has been performed in part to the extent the cancellation right is no longer applicable
If you visit our forecourt, the distance-selling rules don't apply because you've inspected the vehicle in person before purchase.
6. Quality
All used vehicles come with the rights given to you by the Consumer Rights Act 2015 — vehicles must be of satisfactory quality, fit for purpose, and as described. If something is wrong with the vehicle that we should reasonably have caught before sale, we'll work with you to put it right (repair, replacement, or partial refund as appropriate to the issue).
We may sell some vehicles described as "trade sale" or "as-is" — these are clearly labelled and the standard consumer protections may differ. Ask us if you're unsure.
7. Finance & insurance
Where we arrange finance, we act as a credit broker introducing you to one or more lenders on our panel — we are not the lender. We may receive commission from the lender; this commission is disclosed to you before you commit. You have no obligation to use the finance we recommend.
Where we sell insurance products (e.g. GAP), the same disclosure principles apply.
8. Pricing & payment
The advertised price is the cash purchase price. Payment is due in full before the vehicle is released, unless we've agreed financing or trade-in arrangements that change the cash sum due. We accept payment by bank transfer, debit card, or finance approval letter. We do not accept large cash sums (anti-money-laundering reasons).
9. Title
Title in the vehicle passes to you on cleared payment in full. Until then, the vehicle remains our property even if you've taken delivery.
10. Liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any matter where liability cannot lawfully be excluded. Subject to that, our maximum liability for any claim is the price you paid for the vehicle.
11. Complaints
We aim to put things right at first contact. If you're not satisfied, email sales@demo-motors.example marked "Complaint" — we'll acknowledge within 5 working days and respond substantively within 8 weeks. If we still can't resolve it, you can refer the matter to:
- The Motor Ombudsman (motorombudsman.org) — for vehicle quality and sales-process disputes
- The Financial Ombudsman Service (financial-ombudsman.org.uk) — for finance / insurance product disputes
12. Governing law
These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the English courts.
